Research on the path of integrating Socialist Core Values into criminal justiceBased on the analysis of 155 judgment documents on China Judgments Online
The integration of Socialist Core Values into criminal justice is vital to promote the integration of Socialist Core Values into the interpretation of judgment documents.The combination of the rule of law and rule of virtue,people-centered and the organic unity of the"three effects"constitute the theoretical foundation for the integration of Socialist Core Values into criminal justice.Through the empirical analysis of 155 judgment documents from the website of China Judgments Online,it can be concluded that the in-tegration of Socialist Core Values into criminal justice faces the problems of narrow scope of application,lack of discourse conversion,and weak quantitative function.The reasons mainly lie in the low enthusi-asm of judges,the widespread phenomenon of mechanical judicature,the lack of guiding cases,the too rough interpretation of law and legal reasoning,and the strong judicial concept of"heavy conviction and light sentencing".Therefore,it is necessary to effectively reduce the burden of judges,"liberate"them from tedious non-judicial cases,and soften rigid judiciary with Socialist Core Values.Guiding cases should be issued to fully explain the law and reason through discourse transformation and the combination of the common-sense method,the abnormal judicial concept of"heavy conviction and light sentencing"should be abandoned,and the qualitative and quantitative functions of Socialist Core Values should be put forth.
