联合体投标过程中法律风险分析及对策研究

为进一步贯彻落实国家关于推进建筑业高质量发展战略,推进建筑业持续健康发展,自2014年起,国家就开始倡导工程总承包模式,并不断完善总承包项目相关政策及计价规范.在实践中,联合体是工程总承包模式中的主要角色之一,招标人也会在招标文件中明确本项目允许投标人以联合体的形式来参加招投标活动.而在投标实践中,由承包商组成联合体投标的法律问题频频出现,对投标结果产生了重大影响.文章将对联合体投标过程中出现的法律问题进行深入剖析,并提出相应的对策,增强企业的投标风险防范能力.
A Study on legal Risks during Joint Bidding and Countermeasures
To further implement the national strategy of advancing high-quality development of the architectural industry,and promote sustainable and sound progress in this industry,China began to advocate the EPC model in 2014 and constantly improved policies and pricing norms relating to EPC projects.In practice,consortium is one of the major roles of EPC;and it is also clearly stipulated by the tendereein the bidding document that bidders are allowed to participate in bidding in a form of consortium.In bidding practice,legal problems concerning joint bidding by contractors frequently occur and they place a dramatic influence on bidding results.Here,legal problems incurred during joint bidding were profoundly analyzed;and corresponding countermeasures were put forward.In this way,it is expected to enhance the bidding risk prevention capability of enterprises.
