摘要
PPP+EPC模式结合两种模式的优点,整合公共部门和私营部门的优势资源,共同合作进行基础设施建设和运营.这种创新可以打破基础设施建设的僵局,但在我国这种模式的实际应用率并不高.为了实现1+1＞2的目标,文章针对PPP+EPC模式可能存在的法律风险、建造风险、运营风险、变更与索赔风险等进行分析,并提出相应的优化对策.
Abstract
The PPP+EPC mode has advantages of both PPP and EPC.It integrates superior resources in the public and private sectors for infrastructure construction and operation through cooperation.Without a doubt,this is an innovative practice that can break the impasse of infrastructure construction.However,this new mode is rarely applied in practice in China.To achieve the goal of 1+1＞2,this study probes into potential legal risks,construction risks,operation risks,and risks of alterations and claims that relate to the PPP+EPC mode.On this basis,corresponding optimization measures were put forward.
