Legal Definition of Historical Buildings in the Context of Urban Renewal
I n the context of urban renewal,it is necessary to legally define and protect historical buildings.The legal definition of historic buildings abroad has established three typical definition models:designation system,registration system,and dual-track system.In China,the protection of legally designated historical buildings is distinct from that of cultural relics and traditional architectural styles,forming a legal system for the protection of historical buildings with the designation system as the core.However,there are problems such as logical errors in the legal concept of historic buildings,the singularity of the protection system,and inconsistent local identification standards.Therefore,China needs to redefine the concept of historical buildings,adopt a definition model that combines the designation and registration systems,establish unified central legislation for defining historic buildings,and develop a legal protection model for cultural heritage represented by historic buildings with Chinese characteristics.
