Facing the Basic Orientation of Restructuring International Service Trade Rules—Research on Aligning with CPTPP and DEPA's"Prohibition of Requiring Local Presence"
While digital service trade promotes the development of global trade towards servitization,it also poses new challenges to international trade in services rules.For example,both CPTPP and DEPA have established"prohibition of requiring local presence"rules for cross-border trade in services,aiming to reduce international trade barriers and promote the free flow of trade in services.These rules have greatly improved trade convenience and reduced costs,but they have also become a new subject of regulatory concern.Compared with CPTPP and DEPA,China still needs to further relax key regulatory provisions in certain service sectors,such as e-commerce and cross-border data processing.At the same time,the"prohibition of requiring local presence"rule poses challenges to data localization and VAT collection and management of digital international trade in services.Based on a comprehensive review of China's specific commitments to trade in services agreements and domestic regulations,we should use free trade zones(ports)as"experimental fields",incorporating relevant rules for stress testing in consideration of regulatory objectives and capabilities.Meanwhile,relevant laws and regulations should be adjusted in a timely manner to enhance the supervision capability of cross-border trade in services,with the aim of establishing an efficient and transparent supervision system for trade in services.Additionally,we should continue to optimize the policy environment to attract more multinational companies to participate in the Chinese market and jointly promote the internationalization and digitization of trade in services.
