Research on the Application of Informed Consent Rules in the Privacy Policy of Internet Platform Enterprises
The informed consent rule,as the core rule in personal information protection,has been clearly stipulated in the Personal Information Protection Law.However,with the vigorous develop-ment of the internet economy,the informed consent rule faces many difficulties in practice.Currently,Chinese internet platform enterprises apply the informed consent rule through privacy policies,but there are problems such as flaws in fulfilling the obligation to inform,formalization of information sub-ject consent,and incomplete regulatory systems.In order to broaden our thinking and find counter-measures,this article attempts to standardize the rules of informed consent within the framework of the Personal Information Protection Law:in terms of optimizing application,clarifying the disclosure obligation of information processors,ensuring the voluntary consent of information subjects,and strengthening the application of information processing techniques;In terms of protection mechanisms,we will establish a collaborative governance model with multiple regulatory parties and improve the in-fringement relief mechanism of informed consent rules,so as to achieve a balance between the com-mercial use of personal information and the protection of rights and interests,and promote internet platform enterprises to play their due role in applying informed consent rules.
