Data is an emerging factor of production and an important innovation asset,and China has formulated a series of policies and measures to stimulate its innovation vitality.Data intellectual proper-ty(IP)pledge financing represents an innovative financing method,utilizing data legally owned by en-terprises and certified through the data IP registration system or evidence platform as collateral.This approach plays a positive role in unlocking the intrinsic value of data elements.Since 2008,both the central and local governments have successively promulgated laws,regulations,and policies related to IP financing,encouraging civil entities to engage in IP pledge financing activities and sparking a wave of IP pledge financing practices.The diverse practical scenarios serve as empirical evidence for researching this system.By examining the existing legal framework,combining it with practical cases,this paper aims to clarify the issues arising in the development of data IP pledge financing and propose correspond-ing solutions.
