In order to promote the integration of patent licensing information and improve the conversion rate of patent licensing implementation,Article 4 of the Patent Law introduced the patent open licen-sing system in 2020.At the same time,various provinces and cities actively carried out pilot construc-tion of patent open licensing.The patent open license royalties,as a key point in facilitating the parties to achieve patent licensing,directly affects the implementation efficiency,scale,and effec-tiveness of the patent open license system.In practice,there are still shortcomings in the system in terms of incentives,transparency,pricing,and dispute resolution.In view of this,it is necessary to op-timize the incentive mechanism and public disclosure mechanism for the implementation of patent open license royalties,establish non fixed standards for patent open license fees,increase the judicial evalua-tion of patent open license royalties disputes,and improve the system of patent open license royalties to drive the efficient implementation and balance of interests of patent open license.
