摘要
山东省作为经济大省,应当积极推进实现碳达峰与碳中和目标.在地方法治层面,山东省实现碳达峰、碳中和地方法规体系相对欠缺.山东省实现碳达峰、碳中和蕴含的法理包括环境权、环境公平与正义、人与自然生命共同体理念等.在立法多维层面,为了形成"双碳"地方性法规体系,建议山东省制定"山东省碳达峰、碳中和促进条例""山东省蓝碳保护促进条例""山东省碳达峰、碳中和宣传教育条例""山东省能源条例"等地方性法规或规章.在多维地方法治主体层面,山东省机关、企业、环保公益组织及公民个人等应当共同推动实现碳达峰与碳中和目标.
Abstract
Shandong Province,as a big economic province,should actively promote the realization of carbon peak and carbon neutrality.At the level of local rule of law,Shandong Province is relatively short of local laws and regulations to achieve carbon peak and carbon neutrality.The legal principles of achieving carbon peak and carbon neutrality in Shandong Province include environmental rights,envi-ronmental fairness and justice,and the concept of human and natural life community.At the multidi-mensional level of legislation,in order to form a"two-carbon"local legal system,it is recommended that Shandong Province formulate local laws and regulations such as"Shandong Province Carbon Pea-king and Carbon neutral Promotion Regulations","Shandong Province Blue Carbon Protection Promo-tion Regulations","Shandong Province Carbon Peaking and Carbon neutral Publicity and Education Regulations"and"Shandong Province Energy Regulations".At the multidimensional level of local rule of law,Shandong provincial organs,enterprises,environmental public welfare organizations and indi-vidual citizens should jointly promote the realization of carbon peak and carbon neutrality.
