Research on the Convergence Mechanism Between Artificial Intelligence Basic Law and Soft Law in China under the Background of Artificial Intelligence Legislation
The vigorous development of next-generation artificial intelligence technology presents un-precedented challenges to the integration of China's basic laws and soft laws.While the basic laws pro-vide foundational guidance for AI development,soft laws offer flexible and effective means for address-ing specific issues.Integrating both the basic laws and soft laws is essential to meet the requirements of AI-related regulations for flexibility,adaptability,and inclusivity,thereby enhancing the efficiency and effectiveness of legal enforcement.To effectively integrate the basic laws and soft laws,and to construct an AI legal system that conforms to China's characteristics,it is necessary to strengthen policy and reg-ulatory guidance,improve industry standards,innovate legal instruments,enhance public participation and social supervision,and establish a collaborative governance system for AI based on self-regulation,co-regulation,and external regulation,while fostering consensus on AI ethics guidelines and regulatory principles.Guided by this"consensus",it is imperative to establish diverse governance entities and stand-ardized governance processes,clarify the legal definition of AI and its application restrictions,and con-currently draw on international experience while tailoring solutions to China's specific circumstances,thus providing robust legal safeguards for the healthy development of artificial intelligence.
