人工智能时代数据挖掘的限制与例外

摘要
在人工智能时代,数据挖掘技术已成为科技创新与经济文化生活领域的重要技术.中国现行著作权例外制度无法使数据挖掘脱离著作权侵权窠臼.借鉴域外立法与司法经验,构建数据挖掘例外制度,是我国创新发展的需要.以目的是否具有商业性进行区分,将非商业目的下的数据挖掘纳入合理使用制度范畴,将商业目的下的数据挖掘纳入法定许可制度范畴,实现权利人利益与社会公益的平衡.
Abstract
In the era of artificial intelligence,data mining has become an important technical tool in the field of scientific and technological innovation and economic and cultural life.The current copyright ex-ception system in our country can not make data mining out of the pattern of copyright infringement.Learning from foreign legislative and judicial experience and building an exception system for data min-ing is the need of China's innovative development.According to whether the purpose is commercial,data mining for non-commercial purposes is included in the scope of the fair use system,and data min-ing for commercial purposes is included in the scope of the statutory licensing system,so as to achieve the balance between the interests of right holders and social welfare.
