Path Optimization and Empirical Research of Invention Creativeness Judgment Method:UK"four-step method"for Feference
UK adopts a"four-step approach"for patent inventive judgment,the inventive concept is explicitly mentioned,so integrates inventive concept into the"three-step method"to optimize the path of the judgment methods of inventiveness in China,and combined with the two cases,the judgment methods before and after optimization are respectively analyze.The results show that compared with the"three-step method"before optimization,the optimized judgment method is convenient for the examiner to make a more objective and fair judgment on the creativity of the invention.In the"three-step method",the invention idea is incorporated into the creative judgment,which can reduce the subjectivity of the examiner about creative judgment.
