In the digital economy era,cryptography serves as a fundamental technology for ensuring information secu-rity and is increasingly crucial.However,the widespread adoption of cryptography can also have implications for na-tional security and public interests.As a result,the utilization and regulation of cryptography have consistently aimed to strike a balance between safeguarding private rights and meeting enforcement needs,accommodating market-driven forces while considering government intervention,as well as promoting trade freedom alongside national regulation.In recent years,high-quality international trade agreements such as CPTPP and DEPA have integrated regulations for ICT products utilizing cryptography,necessitating the reduction of unjustifiable trade restrictions on such products and fortifying the safeguarding of digital intellectual property.Simultaneously,these international trade agreements also up-hold national cryptographic regulations,encompassing restrictive provisions such as exemptions for financial institu-tions,market exceptions,and allowances for law enforcement agencies.China is actively seeking membership in CPTPP and DEPA,and should also actively adhere to the regulations for cryptography products.In order to achieve this goal,China should vigorously promote commercial cryptography,enhance cooperation and information sharing with member countries of CPTPP and DEPA in the fields of cryptography and cybersecurity,and further refine policies and regulations for the management of cryptography.
