Legitimacy and Justification:The Practical Application of Due Process in Large Integrated Administrative Law Enforcement
As is clearly stated in The Report to the20th National Congress of the Communist Party of China,"with regard to administrative law enforcement,we will advance structural reform to ensure that it is strict,procedure-based,impartial,and civil across the board…".With the deepening of law enforcement reform,the idea of reform from"integration"to"greater integration"has gained new momentum.The two models of"horizontal integration"or"vertical integration"have effectively solved the problems of multiple enforcement,multi-layered enforcement and duplication of enforcement.However,under the reality that administrative penalty powers are constantly being centralized,law enforcement powers are constantly being authorized to the grassroots-level communities,and grassroots-level law enforcement forces are relatively weak;accordingly,the centralization of such a large number of powers inevitably gives rise to problems such as irregularities in law enforcement procedures and simple and rough methods of law enforcement.It has brought about the dilemma of integrating the authority from single law enforcement to comprehensive law enforcement and the dilemma of guaranteeing the foundation from departmental law enforcement to territorial law enforcement.Based on this analysis,applying the due process system to the concrete practice of the reform of large comprehensive administrative law enforcement and giving full play to its safeguard of efficiency,justice and order will be conducive to supplementing the deficiencies of the statutory procedures,effectively improving the level of comprehensive administrative law enforcement,and advancing the development of grassroots social governance towards systematic,holistic and synergistic development.
