Reform Review,Mechanism Adjustment,and Structural Remodeling:A New Exploration of Internal Supervision and Restriction in the Operation of Prosecutorial Power
The internal supervision and restriction in the operation of procuratorial power is an inherent re-quirement for the comprehensive and accurate implementation of the judicial responsibility system.After the ju-dicial reform,the internal supervision and restriction in the operation of procuratorial power have shown new characteristics,such as the refined power of prosecutors in handling cases,more prominent effectiveness of liti-gation supervision,sound and improved intensive mechanisms,and continuous strengthening of external wis-dom.At the same time,there are also new problems that need to be addressed,such as the centralized exercise of prosecutorial power,the need for targeted reinforcement of internal supervision and constraints,the changes of criminal structure forcing the operation of prosecutorial power,and the urgent need to clarify the scope and normative standards of prosecutorial active performance.In response to the new characteristics and problems in the operation of procuratorial power,moderate adjustments need to be made,the internal supervision and re-striction mechanism of procuratorial power can be structurally reshaped from three dimensions:integration,full process,and stratification.
