Discussion on Public Security Organs'Advance Intervention Duty in Civil Cases of Throwing Objects and Falling Objects from High Altitude
The Civil Code of the People's Republic of China clearly stipulates and assigns civil liability for objects thrown out of a building and falling objects from high altitude.In particular,it establishes the right of national public security organs to investigate the infringement of objects thrown from high altitude and falling objects,and clarifies that public security organs need to participate in and intervene in the case of objects thrown out of a building and falling objects from high altitude even if there is no administrative or criminal violation,which breaks through limitations that the cases of throwing and falling objects from high altitude rely on private relief.Starting from the concept of throwing objects from high-altitude,this paper explores the division of civil liability for throwing objects out of a building and falling objects from high-altitude in the Civil Code of the People's Republic of China,and deeply discusses the mechanism of public security organs'early intervention in such cases.
