《论语·子路》及《孟子·尽心上》《孟子·万章上》中关于"亲亲互隐"的文字作为儒家文化情本位观念的一个样本,引发了学界关于这是否是一种滋长腐败的负面因素的正反两极评价.细读文本,双方也许都忽视了孔孟基于其观念立场对亲隐固然有其坚持,但其本质上却是防御性和有限度的.从伦理两难的角度看,情直与正直、亲情与公义间存在紧张关系,但就伦理与道德的分际论,道德本质上应该是超越人之本能从而亲情伦理的,情直不等于理真,而只有在理性基础上健康的公共生活才有可能.在进一步的反思中,亲情原则折射出中国文化缺乏超越性精神向度的特征,这是作为中华儿女的我们应该直面与思考的.
Straightness as It Is,but does that Mean Truth?——On the Issue of"Covering up for the Family Members"in Confucianism
The text in The Analects and The Mencius about the issue of"covering up for the family members"provides a sample reflecting the idea of emotion-orientation in Confucianism,and it provokes the conflict evaluations whether it containing the element which inclines to a corruptive action.Reading the text closely,both sides seems all ignore that though Confucius and Mencius do agree to the"covering up"action,their stands basically are defensive and limited.From the perspective of Moral Dilemma,there are tensions between the"Straightness"and"Rightness"two meanings of Zhi(直)which represents personal relation and public justice respectively.Morality actually means the transcendence of private consideration,this is the truth with regard to the present case,and only on the ground of public reason a healthy public life is possible.In a further reflection,considering and dealing with ethical issue on the personal emotion and private relation reflects Chinese traditional culture's characteristics of lacking the spiritual transcendence dimension,and this deserves us serious examination and reflection.
