Legal Mechanism and Implementation Path of Government Procurement of Elderly Care Services
The government's procurement of elderly care services,namely"the government's procurement of elderly care services from social organizations through a competitive mechanism,"is a specific application of"government procurement"in the governance of our country's aging society.It is an important manifestation of social fairness and justice,and even more so,an innovative measure for the modernization of the state and society as the government transforms its functions and expands market participation.The report of the 20th National Congress of the Communist Party,the national"14th Five-Year Plan,"and a series of policies on government procurement of elderly care services issued in recent years by the Central Committee of the Communist Party and the State Council have outlined the specific goals and directions for actively responding to aging,building a social elderly care service system,and strengthening the modern governance of an aging society in the new era.Currently,various regions across China have made different practical achievements in the government's procurement of elderly care services.However,from a practical perspective,the existing legal systems,such as the"Government Procurement Law,""Tendering and Bidding Law,"Contract Law section of the Civil Code,and even the Law on the Protection of Rights and Interests of the Elderly,still face issues in regulating the"government's procurement of elderly care services."Clarifying the legal mechanisms of the government's procurement of elderly care services and resolving and improving its legal regulatory pathways are of great significance for promoting the modernization of aging society governance and the development of China's aging industry in the new era.
