Revision and Improvement of the Law of the PRC on Promoting the Transformation of Scientific and Technological Achievements——Based on the Perspective of Facilitating the Universities'Transformation of Scientific and Technological Achievements in China
The Law of the People's Republic of China on Promoting the Transformation of Scientific and Technological Achievements which was revised in 2015,has largely promoted the transformation of scientific and technological achievements in universities by solving the institutional problems that negatively affect the process mentioned above.The management institutions for universities are more professional,the relevant normative documents are gradually improved,and the actual results of the transformation of scientific and technological achievements are more and more remarkable.However,there are some problems in the new"Transformation Law"concerning the ownership,obligation,institution system and the role of government and enterprises in terms of regulation.Drawing on the legal experience of the United States and Japan in solving the above problem,it is suggested to start the revision of the"Transformation Law"and the enactment of special laws,appropriately break through the ownership on the ownership of scientific and technological achievements in universities,further clarify the obligations,improve the regulations on institutions in the universities,and set more regulations on the responsibilities of the government and the role of enterprises in order to improve the efficiency and quality of the transformation of scientific and technological achievements.
