大学章程制定主体——“中国式”董事会

一些学者根据相关法律法规习惯性地推断,政府是法律意义上大学章程的"应然制定主体"。现实中大学章程的制定主体是大学,然而这种由大学来制定的章程基本是"一纸空文",难以发挥大学章程应有的作用。根据"依法治教"、"自主管理"的需要,政府或大学都不能单独作为章程的制定主体。借鉴美国确立大学章程制定主体——董事会的相关经验,并结合国情,我国大学章程制定主体应当是由多方利益主体共同构成的"中国式"董事会。
Abstract
Some scholars infer habitually by interrelated laws and regulations that the government is the "ought constitutor subject" of university statute in legal sense.In reality,the constitutor subject is the university,whereas,a statute constituted only by university is useless,it's hard to exert its due function of university statute.To meet the need of "educating on the basic of law"and "the university's self-management",neither the government nor the university can be the constitutor subject of university statute independently.To learn the related experience of America,the constitutor subject of the American university statute is called governing boards,and with the consideration of conditions in China,the constitutor subject of our country's university statute should be made up by Multi-stakeholders,we can call it "Chinese-style" governing boards.
