摘要
章程是大学治理的制度性根基,是依法治校的现实需求和法制现代化的必然选择。章程是具有行政法属性的自治规则,制定依据合法、制定程序合法、表现形式合法是章程有效的前提条件,建立现代大学制度、维护自由权利、规范法律程序是大学章程的价值追求。
Abstract
The Constitution functions as the basic system to manage a university.It is the actual demand for managing a university according to law.Besides,it is the inevitable choice to realize legalization and modernization.Constitution is an autonomous rule,characteristic of administration.The validity of the constitution is based on the legitimacy of procedures and forms.What the constitution of university values and pursues are the establishment of the system of a modern university,the maintenance of the right of freedom,as well as the standardization of the legal procedures.
