平台用工中资本与劳动的利益关系及其法律性质分析

与工业经济时代工厂制劳动雇佣相比,平台用工尽管有着诸多差异性外观与用工逻辑,但其既没有改变资本控制劳动、劳动依附于资本的实质,也没有改变平台企业以从业者劳动创造市场收益的方式获取利润的本质.平台与其从业者间并非平权性民事合作与共享关系,而是以平台从业者自愿接受为表象,以规避和摆脱合法用工掩盖着的隐秘劳动用工关系.平台从业者中的纯粹劳动力提供者与平台企业之间依然存在从属、被控制与被监督的劳动用工关系,故符合劳动用工关系的平台从业者应被纳入劳动法的调整与保护范围.
Analysis of the interest relationship between capital and labor in platform employment and its legal nature
Although platform employment has many differences in appearance and employment logic com-pared to factory based employment in the industrial economy era,it has not changed the essence of capital controlling labor and labor relying on capital,nor has it changed the essence of platform enterprises crea-ting market profits through the labor of practitioners.The parties involved in platform employment are not in an equal rights civil cooperation and sharing relationship,but rather in a hidden labor employment rela-tionship disguised as voluntary acceptance,with the aim of avoiding and getting rid of legal employment costs.There is still a subordinate,controlled,and supervised labor employment relationship between pure labor providers and platform enterprises among platform practitioners.Therefore,platform practitioners who meet the labor employment relationship should be included in the adjustment and protection scope of labor law.
