On the dilemma and path exploration of judicial identification of causality of environmental pollution crime——The theory advocate of double level theory of causality
In recent years,environmental pollution crimes have been developing normally,but the identifi-cation of causality of environmental pollution crimes is faced with many difficulties,resulting in many en-vironmental pollution crimes which have not been punished accordingly.With the key words"environmen-tal pollution crime"and"causal relationship"as the key words,232 criminal judgment documents of first instance are identified as samples.Through multi-angle empirical analysis,it is found that the causal rela-tionship of environmental pollution cases has its particularity,and there are many identification difficulties in the aspects of theory supply and identification technology.Based on this,the paper advocates the two-level theory of causality,adopts the criteria of causality and causality in epidemiology,and scientifically constructs the path map of causality identification of environmental pollution crimes and its key issues to propose feasible countermeasures.
