The predicament and path of the procuratorial organ's participation in the modernization of social governance——From the perspective of source of litigation governance
As the inheritance and development of the"Maple Bridge Experience"in the new era,the govern-ance of litigation sources has a coupling relationship with the modernization of social governance.The source of litigation governance is an important component of the modernization of social governance,the basic path and specific characteristics.On the basis of the dual nature of politics and judicature,procurato-rial organs should assume important functions in the modernization of social governance.In recent years,the procuratorial organs have extended their antennae based on their functions and we are committed to meeting the new needs of the modernization of social governance by promoting the procuratorial proposals,deepening the system of leniency for guilty pleas and punishment,and strengthening the working mecha-nism of the coordination of procuratorial work.However,there are still some problems in practice,such as the weak binding force of the procuratorial suggestion system,the low non-prosecution rate and the poor function of the procuratorial system.Under the macro background of the source of prosecution governance,the procuratorial organ can optimize the source leading function of the procuratorial suggestion by improving the quality of the procuratorial suggestion.By strengthening the application of the right of non-prosecution and fully guaranteeing the right of defense,the function of pre-prosecution diver-sion of the system of confession and punishment will be strengthened,and the function of prosecution dis-continuance will be strengthened through detailed procedures and strengthened cooperation,which makes greater contributions to the procuratorial power to participate in the modernization of social governance.
