On the Supervision over the Temporary Adjustment of Law Application by Authorization and Its Improvement
The temporary adjustment of law application by authorization is different from the traditional type of authorization.It is a new type of authorization with a dual authorization structure created by the National People's Congress and its Standing Committee in the process of building a free trade zone to ease the tension between"comprehensively deepening reform"and"comprehensively promoting the rule of law in China"in the new era.There must be supervision when there is authorization,thus this new type of authorization by the National People's Congress and its Standing Committee also needs a sound supervision mechanism.However,for the practical application of current supervision mechanism,there are still some problems such as the in-adequate filing,review and supervision of the pilot scheme,the imperfect feedback mechanism of the report on the implementa-tion of authorization,and the imperfect acceptance and evaluation mechanism of the authorization effect.Strengthening and im-proving the supervision mechanism of this type of authorization is not only an important basis to ensure the smooth realization of the reform goals set forth in the authorization,but also an internal requirement to strengthen the role of the National People's Congress and its Standing Committee as the main body of authorized supervision.
