On the Construction of the System of Erasing Previous Convictions for Minor Offences in China
In recent years,the criminal legislation of our country tends to activate and lighten the punishment,but the label-ing of minor offences with less social harmfulness and personal danger becomes more and more serious.So,to construct the system of erasing previous convictions for minor offences is imminent.However,the construction of the system is hindered by the crimi-nal record reporting system,the lack of the specific design of the system of erasing previous convictions for minor offences and the unified criminal record registration and inquiry system.Therefore,two aspects should be taken into account in order to construct a sound system of erasing previous convictions for minor offences.The first is to clarify the light nature of minor offences and affirm the system of erasing previous convictions.The second is to explore the construction of the system of erasing previous convictions for minor offences in terms of the subject conditions,investigation period and substantial conditions,with the procedure setting of the application for elimination,approval and cancellation of minor offence records as guarantee for the entity construction.In addi-tion,a sound report and evaluation system of criminal records,a unified criminal record registration and inquiry system,and a per-fect criminal record protection mechanism are used as supporting designs to promote the establishment of the system of erasing previous convictions for minor offences.
