摘要
为了有效遏制当下频发的电信网络诈骗案件,《反电信网络诈骗法》应运而生.该法为了防范跨境电信网络诈骗犯罪,同时赋予了某些机关限制特定人员出境的权力,但是不同于之前的类似措施,此处的限制出境开始具备一种意图降低人身危险性的特点,其可以被认为是行政法上的保安处分.此外,中国行政法上诸多措施也可以被归类为保安处分,但是必须同时对它们的适用提出更加合理的要求.
Abstract
In order to effectively curb the frequent telecom network fraud cases,Anti-Telecom Network Fraud Law has come into being.This law,in order to prevent cross-border telecommunications network fraud crimes,also empowers certain a-gencies with the authority to restrict specific individuals from leaving the country.However,the restriction on leaving the country in this law is different from previous measures.The restriction on leaving the country here exhibits characteristics of intending to reduce personal risks,and it can be considered a security punishment under administrative law.In addition,many measures in Chi-na's administrative law can also be classified as security measures,but more reasonable requirements must be put forward for their application.
