Review and Improvement of Public Litigation for Personal Information Protection
The so-called public interest litigation for personal information protection refers to the inclusion of personal infor-mation protection within the scope of public interest litigation protection.It aims to strengthen the protection of personal informa-tion by using public interest litigation to compensate for the difficulties in proof and high costs in private interest litigation cases in-volving personal information infringement.Public interest litigation for personal information protection is characterized by the public welfare nature of its content,diversity of litigants,and a combination of ex-ante prevention and ex-post remedy.Current-ly,public interest litigation for personal information protection in our country faces issues such as vague rules regarding litigants,general conditions for application,obvious bias in litigation pathways,and a singular type of litigation claims.To fully leverage the effectiveness of the system,it is necessary to continuously improve the public interest litigation system by clarifying the litigants,re-fining the conditions for applying litigation,establishing a mechanism for selecting litigation types,and enriching the liability types of litigation claims,thereby ensuring the smooth operation of public interest litigation for the protection of personal information.
