Analysis and Improvement of Leniency System in China's Antitrust Law Based on Economic Efficiency Goal
Monopoly agreements represent one of the monopoly behaviors governed by antitrust law.Given the inherent concealment associated with such agreements,many countries have identified the leniency system as one of the most effective strategies to combat them.However,the deterrent effect of the leniency system in China's antitrust law has not been fully exploited in current practice,and is often put on the shelf.The goal of economic efficiency,which is one of the most significant objectives of antitrust in China,is also inextricably linked to the leniency system.In order to address the current problems related to the system in China,it is necessary to learn from the United States and South Korea,where the leniency system is relatively mature.We should explore the path of improving the leniency system,refine the scope of applicants for the system,increase punishment intensity and appropriately regulate the discretion of law enforcement agencies to ensure that the system aligns with contemporary needs and ultimately enhances economic efficiency.
