刑事合规不等于企业合规.为了更大限度发挥刑事合规优势,及时给予其刑法制度保障很有必要.我国目前并不存在针对刑事合规的实体激励手段,尚需立法予以补充.双层次激励模式根据刑事合规的程度差异,同时设置了定罪激励和量刑激励两档实体激励方式.在第一层定罪激励中规定"单位制定并实施有效刑事合规计划的,可以不负刑事责任",在第二层量刑激励中规定"单位进行有效刑事合规治理的,可以从轻、减轻或者免除处罚",再确立单位缓刑、单位累犯、单位从业禁止等配套措施,有助于进一步激发企业进行刑事合规的意愿.
Research on Substantive Incentive Path for Criminal Compliance
Criminal compliance is not the same as corporate compliance.In order to maximize the advantages of criminal compliance,it is necessary to offer a timely criminal law system guarantee.At present,there is no physical incentive for criminal compliance in China,and the legislation is yet to be supplemented.According to the difference of the degree of criminal compliance,the two-tiered incentive model sets up two levels of physical incentives,namely conviction incentive and sentencing incentive.In the first tier,the conviction incentive provides that"an entity that develops and implements an effective criminal compliance program may not be held criminally liable".In the second tier sentencing incentive,it is stipulated that"if the unit carries out effective criminal compliance governance,the penalty may be mitigated,reduced or waived".The establishment of supporting measures such as unit probation,unit recidivism,and unit practice prohibition will help further stimulate the willingness of enterprises to engage in criminal compliance.
