摘要
"认购碳汇"是我国环境司法实践中探索出的新型替代性修复方式,既能够满足生态环境的修复需求,也有助于实现我国碳达峰、碳中和战略目标.但现阶段"认购碳汇"的司法适用存在适用范围不明确、适用顺序混乱以及碳汇损失核算方法缺失等问题.为此,应当框定"认购碳汇"的适用范围,明确"认购碳汇"的适用顺序,规范碳汇损失核算的方式,以期为"认购碳汇"司法适用的完善提供具体路径.
Abstract
"Subscription for carbon sink"is a new alternative restoration method explored in China's environmental judicial practice,which can not only meet the needs of ecological environment restoration,but also contribute to the strategic goal of reaching carbon peak and carbon neutrality in our country.However,at present,there are some problems in the judicial application of"carbon sink subscription",such as unclear application scope,chaotic application order and lack of accounting methods for carbon sink losses.To this end,we should frame the scope of application of"carbon sink subscription",clarify the application order of"carbon sink subscription",and standardize the way of carbon sink loss accounting,in order to provide a concrete path for the perfection of judicial application of"carbon sink subscription".
