少年法庭审判机制建设的思考与展望——以长三角地区少年法庭为视角

摘要
党的十八大以来,在纵深推进司法体制机制改革、全面准确落实司法责任制的战略部署下,人民法院内设机构改革渐次展开.面对少年法庭机构调整、职能分化等新情况、新问题,如何坚持少年审判专业化发展方向,是人民法院面临的重要课题.文章以长三角地区少年法庭为样本,调研分析少年法庭审判机制的现状和问题,提出少年、家事审判"合而不同"的发展路径.在此基础上,研提少年法庭审判机制架构,确保少年、家事合一模式下各自人员配置、审判管理等相对独立,以期推动少年、家事审判融合发展.
Abstract
Since the 18th National Congress of the Communist Party of China(CPC),the reform of the Peopl'es Cour'ts internal organs has been gradually carried out under the strategic plan of deepening the reform of the judicial system and mechanisms and fully and accurately implementing the judicial re-sponsibility system.In the face of the new situation and new problems,such as the adjustment of the in-stitutions and the differentiation of the functions of the juvenile court,it is an important task for the Peopl'es Court to adhere to the development direction of the specialization of Juvenile Justice.This article takes the Yangtze River Delta Economic Zone Juvenile Court as the sample,investigates and analyzes the present situation and problems of the Juvenile court trial mechanism,and puts forward the development path of the juvenile and family trial which is"United and different".On this basis,a mechanism for Ju-venile court adjudication is proposed to ensure the relative independence of staffing and judicial manage-ment under the integrated mode of juvenile and family adjudication,with a view to promoting the inte-grated development of juvenile and family adjudication.
