教育法典中受教育权的三维权能研究

The Three-Dimensional Rights of the Right to Education in the Education Code

保障受教育权应当作为编纂教育法典的价值指向和根本依据,这是达致教育公平、促进人的全面发展的必然要求.受教育权的防御权能核心在于国家教育行政机关的"不作为义务",即国家教育行政机关应当尊重并保护公民的教育权利;受益权能强调公民通过向国家提出请求,要求国家教育行政机关积极作为以促进受教育权的实现;发展权能强调教育在促进人的全面发展方面的重要作用.文章提出,教育法典应当整合现行教育法律规范体系,充分保障受教育权的三维权能,强化综合治理机制,为新时代教育事业高质量发展提供坚实的法制保障.
Ensuring the right to education should be the value orientation and fundamental basis for compiling an education code,which is an inevitable requirement for achieving educational equity and pro-moting comprehensive human development.The core of the defense power of the right to education lies in the"duty of inaction"of the national education administrative organs,that is,the national education ad-ministrative organs should respect and protect the education rights of citizens;The emphasis on the right to benefit emphasizes that citizens request the state to actively promote the realization of the right to education through the state's educational administrative agencies;The right to development emphasi-zes the important role of education in promoting comprehensive human development.The Education Code should integrate the current legal framework for education,fully safeguard the three-dimensional rights of the right to education,strengthen comprehensive governance mechanisms,and provide solid legal guarantees for the high-quality development of education in the new era.
