摘要
行政悬赏举报与信用监管存在理念上的结合默契.行政悬赏举报制度的实施弊病与信用监管改革的预期利好塑造了改革必要性,信用监管措施推广的学理基础与实践经验塑造了改革可行性.因此,改革者需分析行政悬赏举报的实施现状,在法律规则中充实信用监管实施的实体保障性与程序支持性安排.在典型制度中重视失信黑名单、信用预警与反馈、信用激励等机制的完善.
Abstract
There is a tacit understanding of the combination of administrative reward report and credit supervision.In addition,the shortcomings of the implementation of the administrative reward report system and the expected benefits of credit supervision have shaped the necessity of reform.The theoretical basis and practical experience of the promotion of credit supervision measures shape the feasibility of reform.Therefore,in legislation,reformers need to enrich the substantive guarantee and procedural auxiliary rules of the implementation of credit supervision.In terms of typical systems,attention should be paid to the improvement of systems such as blacklists for untrustworthiness,credit early warning and feedback,credit files and credit restoration,credit incentives,to promote the construction of a harmonious society.
