高校教师职称晋升申诉权益救济:内涵、章程规范及其优化路径——基于117份江苏省高校章程文本的考察

高校教师职称晋升申诉权益是教师申诉权利的应有之义,是一种学术救济权利。就职务评聘相关事项提出异议或申诉是高校教师职称晋升等申诉权益的表达;救济高校教师职称晋升申诉权益的实质指向在于使其得到公正评价;高校具有救济教师职称晋升等申诉权益的管理责任。当前高校教师职称晋升申诉权益救济的章程规范建设存在以下局限:高校教师职称晋升申诉权益缺位、模糊;公正评价高校老师的管理权责错位削弱教师职称晋升权益受损敏感度;高校关于救济教师职称晋升申诉权益的承诺虚化。优化章程规范是强化高校教师职称晋升申诉权益救济的重要保障,其主要路径有:提高章程中教师职称晋升申诉权益的权利地位;强化章程中高校公正评价教师表现的管理职责;实化章程中教师职称晋升等申诉权益救济机制建设。
Remedies of Appeal Rights for University Teachers'Title Promotion:Connotations,Charter Regulations and Pathways for Optimization——A Study of 117 Articles Text of Universities in Jiangsu Province
The right to appeal for the promotion of university teachers'professional titles is the prop-er meaning of teachers'right to appeal,and it is a right of academic remedy.Raising an objection or appealing for the relevant matters of job evaluation and employment are the expression of the rights and interests of university teachers'professional title promotion.The essence of appeal rights of uni-versity teachers'professional title promotion appeals is to make them get a fair evaluation;universi-ties have the management responsibility to remedy the rights of teachers'professional title promo-tion.At present,there are the following limitations in the construction of regulations for remedies of appeal rights of university teachers'professional titles promotion:the appeal rights for university teachers'professional titles promotion are absent and fuzzy;a fair evaluation of the misalignment of management power and responsibility of college teachers weakens the sensitivity of the damage to the promotion rights and interests of teachers'professional titles;the promise of colleges and univer-sities to remedy the rights and interests of teachers'professional title promotion appeals is vain.Op-timizing the regulations is an important guarantee to strengthen the relief of the rights and interests of teachers'professional title promotion.The main ways are as follows:improving the status of the rights and interests of teachers'professional title promotion;Strengthen the management responsibil-ity of fair evaluation of teachers'performance in the charter;Construction of redress mechanism for the rights and interests of the teachers'professional title promotion in the implementation of the charter.
