摘要
"饭圈"网络暴力行为在网络时代云追星模式下时有发生,传统的司法救济模式和政府部门的监管无法有效预防、控制粉丝群体的网络暴力行为."饭圈"网络暴力治理成为当前紧迫的社会问题.厘清"饭圈"网络暴力的概念、特征、产生机制的内在规律成为研究治理对策的关键步骤.从社会学和法学结合角度出发,可以发现追星过程中的网络暴力并非仅由饭圈粉丝自发形成,而是由缺乏理智的粉丝群体直接推手、追逐利益的娱乐公司幕后主导、博取流量的网络平台暗中助攻、治理网络暴力法规缺失隐形助力的复杂因素作用下滋生.因此,从社会学角度避免乌合之众的聚集,饭圈粉丝应当理智追星、娱乐公司和明星偶像应当承担社会责任;从法学角度平衡权利与义务之间的关系,区分追究直接施暴者、粉头、娱乐公司、网络平台的法律责任.
Abstract
The network violence of"fan circle"often occurs in the cloud star-chasing mode in the Internet era.The traditional judicial relief model and the supervision of government departments can not effectively prevent and control the network violence of fan groups.The governance of"fan circle"network violence has become an urgent social problem at present.To clarify the concept,characteristics and inherent law of the generation mechanism of"fan circle"network violence has become the key step to study the countermeasures.From the perspective of the combination of sociology and law,it can be found that the cyber violence in the process of star-chasing is not only formed spontaneously by the fans of"fan circle",instead,it is promoted directly by the irrational fan group,driven by prof-it-seeking entertainment companies behind the scenes,secretly aided by traffic-grabbing online platforms,and invisibly aided by the lack of laws and regulations governing network violence.Therefore,from the sociological point of view,the gathering of mobs should be avoided,the fans of"fan circle"should be rational to chase stars,and entertainment companies and star idols should assume social responsibility.From the perspective of law,the relationship between rights and obligations should be balanced,and the legal respon-sibilities of the direct perpetrators,fans,entertainment companies and network platforms should be distinguished and investigated.
