摘要
解读不同地区村规民约中宅基地管理制度的主要内容,发现村规民约视角下的宅基地管理制度既有与法律政策相互融合的一面,也有与法律政策不协调的一面,不协调导致了村庄社会的许多冲突与矛盾.如何让村规民约等地方性自治条例更加完善,作为法律政策在村庄内部的细化而不是用来规避法律政策的手段.使其不再是介于自治与法治之间的一种教化型契约,而是具有法律效力的载体,从根本上促进基层民主自治与法律政策相融合的实现.
Abstract
This paper studies the main contents of the house-site management system in the village regulations,it is found that the homestead management system from the perspective of village regulations and folk conventions is not only integrated with the law and policy,but also incompatible with the law and policy,which leads to many conflicts and contradictions in the village society.Therefore,we should think about how to make the local self-government regulations such as village rules and conventions more perfect,as a legal policy in the village,rather than to evade the means of legal policy.It is no longer an edifying contract between autonomy and rule of law,but a carrier with legal effect,which promotes the integration of grass-roots democratic autonomy and legal policy.
