摘要
宅基地三权分置有助于激活宅基地的财产性功能.在宅基地三权分置的实践探索中,资格权的认定及保障既是重点也是难点.针对宅基地资格权认定及实现困难的现实情况,应当合理界定资格权性质与内涵,完善纠纷解决途径,确保农民在退出时有补偿机制,切实维护农民宅基地的合法权益,全面推进乡村振兴.
Abstract
The separation of the three rights of the homestead helps to activate the property function of the homestead.In the practice and exploration of the separation of the three rights of homestead,the identification and guarantee of the qualification right is both the key point and the difficult point.In view of the reality of the identification and realization of the qualification right of homestead,the nature and connotation of the qualification right should be reasonably defined,the dispute resolution channels should be improved,the compensation mechanism for farmers when they exit,the legitimate rights and interests of farmers'homestead should be effectively safeguarded,and the rural revitalization should be comprehensively promoted.
