"三权分置"背景下宅基地流转困境与对策研究

摘要
随着宅基地"三权分置"工作的稳慎推进和房地一体化宅基地确权登记颁证进程的不断完善,农村宅基地的利用和盘活途径成为当下聚焦的热点."三权分置"政策造成了宅基地财产属性与人身限制的冲突、宅基地流转与市场机制结合等问题,本文通过分析当下宅基地流转所面临的所有权表达瑕疵、使用权流转法理争议、成员权界定困境与背后的多重成因,结合试点地区的典型案例,探讨如何从完善宅基地所有权、明确成员权和适度放活宅基地流转的角度破除当下宅基地流转难题,为宅基地的深化改革提供新的方向.
Abstract
With the steady and careful promotion of the"three-right separation"of homestead and the continuous improvement of the registration and certification process of real estate integration homestead,the utilization and revitalization of rural homestead have become the focus of the moment.The policy of separation of three rights has caused conflicts between property attributes of homestead and personal restrictions,and the combination of homestead circulation and market mechanism.By analyzing the defects of ownership expression,legal disputes over the circulation of use rights,difficulties in defining membership rights and multiple causes behind them,combined with typical cases in pilot areas,this paper discusses how to solve the problems of homestead circulation from the angles of perfecting homestead ownership,clarifying membership rights and moderately activating homestead circulation.It provides another direction for deepening the reform of homestead.
