Legislative Options and Logical Justification for the Incorporation of Energy Regulations into the Environmental Code
Whether and how to incorporate energy regulations into the Environmental Code is a hot topic in current theoretical research.The academic community has formed two opposite claims as"incorporation"and"not incorporation",which are rooted in the cognitive differences on the relationship between environmental law and energy law.The two-dimensional relationship hat the two laws vary in concepts but couple in regulation requires the determination of"targeted practical problems"for judging whether to corporate energy regulations into the environmental code.The relatively centralized form of the energy regulations in the"green low-carbon development chapter"is in line with the environmental code to respond to the needs of the times and gain the inner system of the practical logic.Its inclusion in the"Green and Low-Carbon Development Chapter"has reshaped the content structure based on the closed loop of the economy,forming a logical pattern of structural causality with the concept of"green and low-carbon development"as the core trend.In this way,the"green energy"chapter is formally equal and substantively coupled with other chapters in the series.Through the further arrangement of the underlying logic of"supply and integration"of energy norms,the macro,meso and micro codification logic of"green and low-carbon development"can be presented in a multi-dimensional way.
