近年来在网络游戏著作权保护的问题上,我国理论界和实务界存在诸多争议.这些分歧反映出各界在著作权法基本理论方面取得的共识甚少,如此,不仅司法效率受到影响,网络游戏产业界也难以获得具有较强明确性的预期.因此,有必要回到著作权赋权的基本原理,以之为基础构建恰当的认知作品及作品类型的著作权客体理论,藉此得以在体系化的著作权制度逻辑下解析网络游戏,包括其客体地位、独创性分析框架、著作权保护路径等,从而形成合理的、统一的裁判逻辑,回应当下有关网络游戏著作权保护的激烈争议.
On the Judgment Logic of Copyright Protection of Online Games
During recent years,there are many disputes in China's academic community and practice field on the issue of copyright protection of online games.These disputes reflect the lack of consensus on the basic theories of copyright law,so that not only is judicial efficiency affected but the online game industry is also difficult to obtain strong clear expectations.In view of this,it is nec-essary to go back to the basic principles of copyright entitlement and build an appropriate copyright object theory for recognizing works and types of works based on it,so as to analyze online games un-der the systematic logic of copyright system,including their status in the system of copyright subject matter,analysis framework of originality,copyright protection path and etc.,which will be great helpful to form a reasonable and unified judgment logic and respond to the current heated arguments over copyright protection of online games.
