网络虚假信息元规制模式的确立及其展开

摘要
现行网络虚假信息规制可划分为行政规制模式和自我规制模式,但两种模式与大数据时代网络信息规制现实需求存在逆差.元规制模式可以弥补行政规制模式和自我规制模式的局限,因应新时代网络虚假信息规制与公民权利保护的平衡要求.元规制模式中,政府应通过法律法规为网络平台规制虚假信息设置公共利益目标及识别标准要求,提升虚假信息规制效能.政府应对网络平台自治规则和履行义务情况进行后设规制,确保平台切实履行网络虚假信息规制主体责任及实现公共利益目标.此外,还应构建主体协同联动及监督救济机制,加强规制主体间的协调合作,防止网络信息规制行为侵犯公民权利.
Abstract
The current regulation of online false information can be divided into administrative regulation mode and self-regulation mode,but both modes have a deficit with the practical needs of network information regulation in the era of big data.The meta-regulatory model can compensate for the limitations of administrative and self-regulation models,and meet the balance requirements of regulating online false information and protecting civil rights in the new era.In the meta-regulatory model,the government should set public interest goals and identification standards for regulating false information on online platforms through laws and regulations,in order to enhance the effective-ness of false information regulation.The government should establish post-regulation on the autono-mous rules and obligations of online platforms to ensure that platforms effectively fulfill their main re-sponsibilities for regulating online false information and achieve public interest goals.In addition,it is necessary to establish a collaborative and supervisory mechanism among regulatory entities,strengthen coordination and cooperation among regulatory subject,and prevent online information regulation from infringing on civil rights.
