数字化是一场革命,引发了市场竞争形式的变革,驱动数字市场竞争由价格中心向用户中心化趋变.数字市场竞争之变在主体、行为、价值和技术等层面对工业时期的竞争法规则形成冲击,并造成竞争法数字化适用的障碍.数字经济下的竞争具有双重性:既是市场内竞争,也有市场间竞争;既具有破坏性,也具有创造性;其竞争形式围绕用户竞争展开,关涉市场创新.数字化催发的竞争变革有着坚实的经济基础和合理的竞争正义表达.竞争法的因应需顺应数字竞争的用户中心与创新效率面相,注重数字经济生产所承载的动态效率、积极自由、公平表达与竞争规则的适配性,在制度构设中加强用户自由保障、用户公平维护与用户价值遵循.
Adapting Competition Law to Competition Changes in the Digital Economy Era
Digitalization is a revolution that triggers changes in market competition,shifting digital market competi-tion from being"price-centric"to"user-centric".These changes in digital market competition impact the competition regulations established during the industrial era in terms of entities,behaviors,values,and technologies,causing ob-stacles in the application of digital competition laws.Competition in the digital economy exhibits dual characteristics:it involves both intra-market and inter-market competition;and it is both destructive and re-constructive.Competition in the digital economy revolves around user-centric competition and involves market innovation.The competition changes sparked by digitalization are rooted in solid economic foundations and express reasonable competition justice.Adapting competition laws in response should align with the"user-centric"and"innovation efficiency"aspects of digital competi-tion.It should focus on the adaptability of dynamic efficiency,active freedom,fair expression,and competition rules re-lated to digital economic production,while enhancing user freedom protection,fairness maintenance,and adherence to user values in institutional design.
