作为规范不起诉裁量权行使的一项司法程序,不起诉听证的引入旨在增强审查起诉程序的公开性与对抗性,以在查明案件事实的前提下实现"定分止争"的诉讼目的.身具社会评价职能的听证员介入听证程序,形成了"控辩审听"的全新审查起诉构造.不起诉听证实践却表明,检察机关主持下的听证程序仍未脱离传统书面审查模式的桎梏,听证案件的选择背离了"应听尽听"的制度初衷,听证员参与的实质性不足,案件评议流于形式,听证程序由"检察主持"异化为"检察主导".不起诉听证程序应回归多方参与的诉讼构造,重视辩护方的权利保障,增强听证员参与的实质性,确立争议点主导模式,探索"不起诉听证+"机制.
Pragmatic Depiction and Utopian Condition of Non-prosecution Hearing
As a judicial procedure that regulates the exercise of non-prosecution discretion,the introduction of non-pros-ecution hearings aims to enhance the openness and confrontation of the review and prosecution procedures,so as to achieve the litigation purpose of"settling the division and stopping disputes"on the premise of ascertaining the facts of the case.Hearing of-ficers with social evaluation functions intervened in the hearing procedures,forming a new review and prosecution structure of"prosecution and defense hearings".However,the practice of non-prosecution hearings shows that the hearing procedures under the auspices of the procuratorial organs have not yet broken away from the shackles of the traditional written review model,the se-lection of hearing cases deviates from the original intention of the system of"hearing everything that should be heard",the sub-stantive participation of hearing officers is insufficient,the case deliberation is a mere formality,and the hearing procedure has been alienated from"presided over by the procuratorate"to"led by the procuratorate".The non-prosecution hearing procedure should return to the multi-party litigation structure,attach importance to the protection of the rights of the defense,enhance the substance of the participation of hearing officers,establish a dispute point dominant mode,and explore the"non-prosecution hearing+"system.
