The Agricultural Production and Technology in the Litigation Custom in Jiangxi During the Song Dynasty
During the Song Dynasty,it was believed that many people in Jiangxi were litigious and litigation custom was prevalent.Litigation custom reflected the intensification of social conflicts and the reconstruction of social order in the context of a-gricultural development.Without using perspectives such as legal culture and local governance,this paper studies the regional distribution of litigation custom and its relationship with agricultural development from a comprehensive perspective of human-land relations,social relations and agricultural technology.The research findings are as follows.Firstly,litigation was a widespread social custom in Jiangxi during the Song Dynasty.Secondly,lawsuits were frequently initiated in Jizhou,Ganzhou,Yuanzhou and Yunzhou.Moreover,Raozhou and Xinzhou were considered the regions most prone to litigation.Furthermore,factors such as the irregular shape of field,encroachment on neighboring farmland,and forgery of contracts led to lawsuits over ownership of farmland,and the struggle for production materials was the core of social contradictions at that time.Thirdly,"forced harvesting of rice"re-flected the encroachment on farmland management rights.The independent and flexible small-scale peasant mode of production after family break-up was suitable for the development of agriculture in Jiangxi during the Song Dynasty,and the small-scale peasant mode of production was based on agricultural technology represented by the"one buffalo pulling plow"technology.
