Defining the administrative responsibility in the third party governance of environmental pollution
The third party governance model for environmental pollution is an important way to promote the marketization,specialization,and industrialization of environmental pollution governance.However,because the existing rules cannot provide sufficient basis for the definition of the administrative responsibility of the parties,there have been issues in the third party governance,such as unclear situations of the third party assuming administrative responsibility,the vague application and standards of the types of administrative punishment and the lack of effective regulations on the exercise of administrative prior rights.Therefore,on the basis of distinguishing the types of third-party governance models,it is necessary to clarify the situations in which the third party assumes administrative responsibility,and to determine the specific ways of administrative penalties by focusing on the degree of contract performance and introducing enterprise environmental credit evaluation,and strengthen the normative restrictions on environmental administrative agreements to promote the effectiveness of the third-party governance models in operation.
