Optimizing the governance of organizational crimes of infringing on citizens'personal information——from the perspective of criminal compliance
Organizations are key entities in collecting and utilizing citizens'personal information.However,cases of organizations infringing on personal information often exhibit low criminal investigation rates,a wide range of industries involved,large-scale breaches of personal information,and inconsistent punishment standards.This indicates that the current criminal law has been less effective in addressing organizational infringements on personal information.As a state-endorsed tool for addressing corporate crime,criminal compliance encourages organizations to establish effective risk prevention mechanisms and promotes regulated operations,ultimately helping to address corporate crime at its source.Therefore,by focusing on the current trends and issues surrounding organizational infringements on citizens'personal information,improvements can be made in three key areas:clarifying standards for information usage compliance,encouraging organizations to implement compliance mechanisms,and basing criminal compliance on the degree of harm to legal interests.Establishing a more targeted criminal compliance governance model will help ensure the protection of citizens'personal information from the source.
