Parallel conflict problem and specialization approach of multiple systems of geographical indication protection in China
Geographical indication(GI)is a public brand associated with the product of a specific region.GI right is a unique intellectual property right between commercial marks and creative intellectual achievements.The protection of geographical indications in China encompasses trademark law and collective trademark,certification trademark regulations,geographical indication product regulations,agricultural and forestry product geographical indication regulations.This diverse and parallel legal framework suffers from a lack of unity and professionalism,resulting in mutual constraints and conflicts.From the legal,historical,and practical perspectives of geographical indication protection,it can be proven that the specialized protection of geographical indications in China is necessary and inevitable.Therefore,for completing the system integration of geographical indications protection,the protection of geographical indications in our country should combined from diversified system to specialized protection;for completing its standard upgrade,should formulate a unified,specialized geographical indication protection law;and for completing the establishment of its special organization,should establish a special department for the protection of geographical indications,so as to realize the unified management and effective protection of geographical indications.
