摘要
坚持总体国家安全观,是维护国家安全的新要求.刑法与总体国家安全具有密切关系.在总体国家安全中,刑法安全观须臾不可缺失.维护总体国家安全是刑法的核心任务,高度重视总体国家安全,这是时代的呼唤.总体国家安全中的"总体"要求和刑法惩治犯罪行为的广泛性具有对应关系.刑法内容的细致性、手段的多样性和执行的强制性,为总体国家安全中的"安全"提供坚实有力的法治保障.我国总体国家安全的基本法律体系,以宪法为总纲,以国家安全法为主线,以刑法为保障手段.如何维护总体国家安全,刑法总则和分则有细致规定,在体例、行为性质判定、罪名确定、刑罚以及发展变化上呈现出相应特点.但也存在问题,主要表现在立法理念、协调机制、执法效果、秩序构建、环境营造等方面,应当通过确立宪法原则、总体国家安全刑法观原则、刑事政策同步跟进原则等完善指导体系,通过健全刑法和国家安全法衔接机制,充实总体国家安全刑事政策等完善机制体系,通过保障要素安全、一体化维护等完善措施体系.
Abstract
Adhering to the holistic national security concept represents a new imperative for safeguarding national security.There exists a close relationship between criminal law and overall national security.In the context of overall national security,the perspective of criminal law on security is indispensable.The core mission of criminal law is to maintain overall national security,which is profoundly resonant with contemporary demands.The"holistic"requirement in overall national security corresponds to the extensive reach of criminal law in addressing criminal activities.The detailed nature of criminal law content,its diverse methods,and the mandatory nature of its enforcement provide robust legal protection for the"security"aspect of overall national security.The fundamental legal system for overall national security in our country is structured with the Constitution as the guiding framework,the National Security Law as the main thread,and the Criminal Law as the means of protection.The criminal law's general provisions and specific provisions offer detailed guidelines on how to safeguard overall national security.These guidelines exhibit distinct characteristics in terms of structure,determination of the nature of acts,identification of offenses,penalties,and their evolution.However,challenges persist notably in legislative concepts,coordination mechanisms,enforcement efficacy,order construction,and environmental creation.To improve these issues,it is essential to establish guiding principles such as the constitutional principle,the principle of the overall national security criminal law perspective,and the principle of synchronous advancement of criminal policy.Additionally,improving the mechanism system by enhancing the linkage between criminal law and national security law and enriching the criminal policy of overall national security is necessary.Additionally,strengthening the measures system by ensuring the safety of key elements and integrated maintenance is crucial.
