A Study on the Indigenous Discourse in the Customary Laws of Ethnic Minorities in the Qingshui River during the Qing Dynasty
In the Qing Dynasty,the ethnic minority regions along the Qingshui River basin underwent significant changes in their traditional social life due to the implementation of the policy of"opening up new territories"and the influx of Han culture,legal spirit.This resulted in the formation of a customary law culture primarily manifested through"stone tablets","contracts"and"ancient songs".These customary laws embodied indigenous discourses such as"jin","yi","ming","luo","zhong","gong",which not only resonate with the ancient Chinese philosophical ideals of"harmony","integrity"and"the doctrine of the mean",but also align with modern legal concepts like"public order and good customs","honesty and credit"and"procedural justice".These indigenous discourses embedded in the traditional wisdom of ethnic minorities showcased the history of interactions,exchanges,and integrations a-mong China's diverse legal cultures,and provided local resources and historical foundations for the construction of contemporary Chi-nese legal discourse systems.
